Contractor Stalked Customers In Stores, Sentenced For Grand Theft

Wednesday, August 27, 2008 – updated: 1:08 pm EDT August 27, 2008

A contractor Action 9 exposed, for stalking customers in home improvement stores....has been sentenced, for grand theft and illegal contracting. As part of his sentence, he's banned from going into local Home Depot and Lowes stores. Todd Ulrich reports... some victims, who lost big deposits...say that's not enough.

Six months after Action 9 first exposed contractor Jim Metts--- he has pleaded no contest to felony charges of grand theft and unlawful contracting.

His victims have mixed feelings.

"That's a good thing, but I'd like to see more. I'd like to see him pay fines and restitution," said Kay King.

She says that case only helped one woman recover a deposit. Kay is still out the 15 hundred dollars she paid Metts to install new doors---that were never completed.

Action 9 uncovered at least 20 more victims---many approached in home improvement stores. Our hidden camera investigation found him stalking customers at an East Colonial Home Depot.

(Todd)"I don't think you're going in there to buy anything." (Metts) "Yeah." (Todd) "I think you're hear to shop for more victims." (Metts) "Yeah."

One criminal case by the Orange County Consumer Fraud Office could end Jim Mett's trips through the aisles at home improvement stores. His sentence includes 3 years supervised probation.

That probation comes with a special condition. A judge ruled Metts must stay away---and not enter any Home Depot or Lowes stores in Central Florida.

That does encourage victims like Kay who Metts approached in a local Home Depot---then talked her into giving him a fat deposit check.

"He shouldn't be in there. He shouldn't be preying on unsuspecting people," said Kay.

Since our first report, Metts agreed to full refunds for two other consumers. We know a dozen other homeowners still feel cheated, and some of those folks are filing complaints with Orange County Consumer Fraud.
