Man Found Guilty Of Murdering Off-Duty Cop

An Orange County jury found Davin Smith Guilty of first-degree murder Friday. The jury deliberated the case for more than five hours and eventually ruled that the 20-year-old killed off-duty officer Al Gordon during a botched robbery in 2007.

He was also found guilty of attempted robbery with a firearm and of robbery with a firearm.

Late Friday morning, attorneys finished their closing arguments in the Davin Smith murder trial. Smith gunned down officer Al Gordon outside a Pine Hills ATM.

"You heard from Lou Pearlman that Davin said he shot him," Assistant State Attorney Robin Wilkinson said during closing arguments.

"Where are the tape recordings that could've been made? Where was the follow up?" Public Defender Marc Burnham asked.

"Davin Smith went from a bashful boy to a boastful man, a cop killer," Wilkinson said.

Smith's accused accomplice, Hugo Terry, refused to testify against him, leaving jurors to only consider the testimony of Smith's fellow Orange County inmates and the circumstantial evidence linking Smith to the crime. Terry, has already been convicted and is awaiting sentencing.

That included a 9mm Ruger used in the shooting. Neither Smith's DNA nor his fingerprints were found on the weapon. Gordon had his own weapon, but was shot before he could reach it.

Davin Smith may face the death penalty at sentencing.
