Jury Recommends Death Penalty For Prison Guard's Killer

After two hours of deliberations, a jury in Daytona Beach recommended the death penalty for Enoch Hall Thursday night. Eyewitness News has followed this story since the crime happened 16 months ago and was in the courtroom when the verdict was read.

The jury voted 12 to zero to send him to his death.

Last week, Hall was convicted of stabbing officer Donna Fitzgerald to death at Tomoka State Prison . Her family was in the courtroom. They told Eyewitness News it was the only just sentence for Hall, who even behind bars found a way to ruin lives.

"She deserved the justice for what she went through. She was fighting for her life. And that, that is the right verdict," said Dana Shaure, Donna Fitzgerald's sister.

Prosecutors detailed Fitzgerald's fight for her life to the jury, focusing on her 22 stab wounds from a sheet metal shank.

"He killed a corrections officer in the line of duty while serving a life sentence. You don't get any more aggravated than that," Assistant State Attorney Leah Case said.

Hall's public defenders said he had little to say and was somewhat resigned to his fate.

"I know he's very remorseful for what happened to Officer Fitzgerald and it's difficult for him to explain," said Hall's attorney, Matt Phillips.

Even after the decision, Hall's attorneys maintain the seizure pills he took the day of the murder may have increased his condition and mental state.

Hall has another hearing in front of a judge next month, who will eventually make the final decision on his death sentence.
