Just before Allen was led to the Brevard County jail in handcuffs, he talked for about half an hour with Titusville's assistant police chief. On the recording, he says he didn't initiate the proposition for oral sex and that it was the undercover officer's doing."The first mentions of sex and the first mentions of money, any of this came from that individual, which I didn't know if he was out for sex or out to see if I was carrying money in my pocket," Allen said on the recording. While police said the lawmaker walked suspiciously around the park and in and out of the bathroom several times, Allen said he went along with the conversation out of fear, even when it turned to sex, believing he was about to be robbed."This was a pretty stocky black guy and there was nothing but other black guys around in the park," Allen was recorded saying. "Then he walks past and then you can see that's that guy. 'Oh, I'm about to be a statistic here."Attorney Christopher Beres, though, said there are serious questions about whether the recordings will be admissible in court, but they offer the court of public opinion some new insight into the allegations surrounding the lawmaker. In a police statement that was also released, a Titusville officer noted that, as Allen was being put into the patrol car, Allen said, "I don't suppose it would help if I said I was a state legislator, would it?" and the officer replied, "No."Allen is scheduled to be arraigned on the formal charges August 23.
