HOA Forcing Man To Change Back Yard After Xeroscaping

Posted: 5:58 pm EDT March 26, 2008

An Osceola County man thought his homeowner's association would support the thousands he spent on a yard that would require less watering, but he was wrong.

Homeowner Michael DiMarco took out a quarter of his grass, relying on a state statute that forbids HOA's from blocking environmentally-friendly changes known as xeroscaping, but a judge ruled the HOA still had some control.

DiMarco now has two months to change it back.

"Having to put back the grass, especially during a time when we're going into our driest season. New turf needs lots of water," he said.

DiMarco plans to lobby state legislators to clarify the existing statute to allow homeowners to go ahead and plant what they want without having to get HOA approval.
