Orange County Judge Says SunPass, E-Pass Violations Overwhelming Court

ORANGE COUNTY, Fla. -- An Orange County judge told Eyewitness News that SunPass and E-Pass file so many violations, they can't seem to keep up with the prosecution in court. Those same citations have forced thousands of drivers to lose their license and some didn't do anything wrong.Orange County Administrative Judge Carolyn Freeman said most of the people in her court room had no idea they had any toll citations until they got a letter from the clerk's office saying their driver's licenses was suspended and judges are spending a lot of time trying to clear up the mix-up.Judge Freemen spent an entire day hearing dozens of SunPass and E-Pass cases a few weeks ago."No representative from the toll authorities were present and all the cases were dismissed," she said.Freeman said so many customers are trying to fight their citations in court, the toll agencies can't keep up."The toll authorities are going to Orange, Seminole, Brevard, Osceola and Lake. If our hearings happen to be set on the same day as one of those other areas, they have to pick which they are going to attend," she said.Judge Freeman said a lot of the problems could be cleared up if SunPass and E-Pass would just communicate."They don't even talk to each other," she said. "SunPass doesn't even check with E-Pass to see if you have an E-Pass and they can charge you. They just issue you the citation."
