SunPass Wants Judge To Reinstate Citations

ORLANDO, Fla. -- The Florida Department of Transportation has asked a judge who threw out an estimated 7,000 traffic tickets to reconsider his ruling, saying it was too broad.

The ruling came shortly after an Eyewitness News investigation exposing frustration with tactics used by the agency regulating SunPass and how it was dealing with people who had received citations connected to their toll transponders. The department has filed papers to ask Circuit Judge John Galluzzo for a rehearing in the case. The case involved drivers with malfunctioning devices used to pay tolls. Department attorney Gregory Costas says Galluzzo was wrong to issue such a sweeping order in the case, which asked him to rule only in the case of one driver. Galluzzo dismissed the tickets, which involved drivers in Seminole and Brevard counties, in April. The citations involved drivers who had E-Pass and SunPass toll systems.
