Man Arrested For Hit And Run Says He Stayed At Crash Scene

ORANGE COUNTY, Fla. -- An Orange County man was arrested for a hit and run crash, but he says he never ran from anything. He says he stayed at the crash scene with an Orange County deputy.Records seem to show there was a deputy at the accident scene. The problem for Robert Barnhill is, he said, he didn't realize he had to wait for an FHP cruiser to arrive."He told me he didn't care what I had, that I was going to jail," Barnhill told Eyewitness News.Barnhill certainly has plenty of paperwork ready for his upcoming trial. He says it is all evidence to show that he left an accident scene believing an accident report had already been created."I was never told to wait for anyone," he said.In Orange County, deputies never take accident reports, but Barnhill said he didn't know that. He says another driver cut him off. When she went to a hospital, he said Deputy Anthony Witmore took his information and then left.Eight months later, Barnhill ended up in jail for hit and run, but witness statements put him at the scene after the crash and the hospitalized woman told a trooper she saw him there. Dispatch logs appear to place a deputy there, too."[The deputy] witnessed the accident," Barnhill said, adding he assumed the deputy did a report. "Nobody told me to stay."The Florida Highway Patrol can't talk on camera, because they're ready to go to trial. They don't buy Barnhill's story, because he never mentioned the other officer on the scene until now and investigative documents make it clear the Highway Patrol is sticking to their belief that Barnhill knew he was to remain at the scene, but left anyway. Witnesses indicate he even moved crime scene tape to get his car."Bottom line is, I tried to render first aid, people saw me there by her car, I met my responsibility," he said.According to the arrest warrant in the case, the investigating officer believes Barnhill only disputed the hit and run charge after his insurance company denied the claim to repair his car. Both sides of the dispute are now waiting on a trial date to let a jury decide who's right.
