Casey Anthony Won't Get New Bond Hearing

ORANGE COUNTY, Fla. -- An appeals court denied Casey Anthony's request for a new hearing to have her bond lowered, Wednesday afternoon. The denial means Anthony will remain in jail unless her $500,000 bail is posted.

In an earlier response to Anthony's request for a new hearing, the Florida Attorney General's Office wrote that her attorney "had failed to show the trial court abused its discretion.""A trial court's determination will be upheld by the appellate court 'unless the judicial action is arbitrary, fanciful, or unreasonable, which is another way of saying that discretion is abused only where no reasonable man would take the view adopted by the trial court,'" the Attorney General's Office wrote in the response. "The court set out what it determined to be reasonable conditions for Petitioner's release, and Petitioner has failed to show that such action by the trial court was 'arbitrary, fanciful, or unreasonable.'"Attorney Jose Baez wanted the appeals court to step in and help him get Casey Anthony out of jail. He hoped to get another bond hearing for his client to drastically reduce Casey's current $500,000 bond..Eyewitness News learned the results of Casey's psychological evaluation were turned over to the Fifth District Court of Appeals and they were the ones who ruled Wednesday afternoon that she would not get another bond hearing. The results of that evaluation are sealed.
FORMER INMATE SAYS CASEY TALKED TO HIMAlso Wednesday, Eyewitness News spoke to a former inmate who allegedly talked with Casey Anthony before her hearing Tuesday and he was told an entirely new story about where Caylee is."I was asking her where the baby was. She said, 'I don't have the baby,'" said former inmate Travis Nichols. "Her ex-boyfriend has the baby. She didn't say where.""Did she say who that was?" WFTV reporter Kathi Belich asked."No. And she started smiling and then she went into the cage and went into court," he said.Nichols admits he was in jail after being accused of burglary, but insists he isn't trying to use the information for his own gain. He doesn't believe what she told him is true."They're changing stories left and right," he said.The jail is checking records to verify that Nichols was in the holding area Tuesday when Casey was there. If they were both there, the jail said it is possible they could have exchanged words through the transparent dividers.
COURT DENIES MOTION TO BLOCK RELEASE OF CALLSGetting Casey out of jail would assist Baez in his goal of getting her out of the media spotlight. Every visit or conversation she has with someone outside of the jail is being released to the public. Tuesday afternoon, Baez was denied his motion to prevent jailhouse calls from being released because a judge said it was not hampering the investigation into Caylee Anthony's disappearance.Tuesday night, Baez explained his reasoning for the motion."The reason for that is the only people who are talking to her and communicating with her is the family. They are trying to find out more info useful for search and if someone has Caylee, and their finding out they are getting closer to me, that's dangerous," said Baez.Anthony's lawyer wanted the court to prevent the Orange County jail and the sheriff's office from releasing any more of her jailhouse conversations."Your position, Mr. Baez, seems to be, 'Just trust us. We're trying to do an investigation here. If we get anything we'll tell you about it. Just trust us.' Well, it just doesn't work that way," Judge Stan Strickland said.Baez argued recent audiotapes of 911 calls and calls Casey Anthony made from jail should stay out of the hands of the media, but the judge said Baez just didn't like the negative publicity and he decided the calls can still be released."Worst case scenario, it just looks like it may be more difficult to pick a jury, but we deal with that every day," Strickland said. "When push comes to shove, in a case like this, I'm gonna err on the side of the First Amendment every time. And I'm going to do so here by denying your motion."
