Angry Homeowners Having Trouble Filing Class Action Suit Against Maronda Homes
Hundreds of homeowners across Central Florida hoping to file a class action lawsuit against a major homebuilder are running into problems.They accuse Maronda Homes of shoddy construction after having all kinds of problems with water intrusion after Tropical Storm Fay. But a number of law firms have turned down the homeowners.Two months to the day after Fay, the problem for Soheir Nasr is mold infesting her house. Water intrusion left her with walls like a wet sponge and huge repair bills."Around seven grand… to fix the house inside and outside and the carpet and the door," she said.Along with more than 300 homeowners in Celery Lake and around Central Florida, Nasr's been hoping a class action lawsuit against Maronda Homes might recoup some of those costs.Attorney Zander Clem says even though the water intrusion problems seem similar in the homes, they may not be similar enough in the eyes of the court to grant class action status."You may have one guy who has minor damage from water intrusion coming through stucco when somebody else has roof damage," said Clem.Michael Wilk helped organize angry Maronda homeowners and says one South Florida firm remains very interested in pursuing the class action case. Even if that fails, individual homeowners do have recourse."There's no reason why individual claimants can't still pursue their case with a contingency fee lawyer," said Clem. "It'll just make it a little bit harder."From the outset, Maronda Homes has claimed the problems resulted from homeowner neglect, not shoddy construction.
