A Sanford family is being forced to live in a flood-damaged home because their mortgage company won't send an insurance check they can actually cash. The check... is made out, to a woman who has been dead, for 9 years. When no one else would listen, they called Action 9's Todd Ulrich for help.Black mold stains several rooms at Tayuwanna Williams' Sanford home and that's just part of the damage. The house was swamped by Tropical Storm Fay flood waters in August. The insurance company settled a 10 thousand dollar claim but Tayuwanna can't cash the check---because it's made out to her---and her mother Margaret Jones.(Todd) "Why is that a problem?" (Tayuwanna)"....because she's been dead for nine years..."Her lender, IndyMac Bank has refused to remove her mother's name from the check, even thougth Tayuwanna has sent her mom's death certificate, a final will, and property records, that show she's been the sole owner since her mom died. The insurance company can't reissue a check in just her name. Indy Mac cashed the first check and it has all the money. Tayuwanna just can't sign her mother's name, even if she wanted to."They would need current id to cash the check," said Tayuwanna. Of course that i.d. doesn't exist.Indy Mac, that failed last year, has not returned our calls. So we contacted Florida Financial Services-----which asked federal regulators to review the case so this family can finally recover."I didn't know where to turn, and my daughter did, she turned to you guys," said Tayuwanna.IndyBank is based in California, so the Federal Office of Thirft Supervision will review the case, and I'm told this should be resolved within the week.
