Teacher Won't Be Charged For Kissing Student

It was an affair uncovered through text messages, but Eyewitness News found out an Orange County history teacher will not face any charges or even be disciplined for an inappropriate relationship with a 16-year-old student.

Even the suspect himself may have been expecting charges, so he moved away.

Andrew Barrett, 31, resigned from Dr. Phillips High School on Friday after his wife turned him in for having an inappropriate relationship with one of his students.

"She herself felt obligated to tell the school. It was not an easy thing to do, but it was the right thing to do. He is a teacher," said Sgt. Barbara Jones, Orlando Police Department.

Barrett has been a history teacher at the high school since 2004. He is also an advisor for the National Honor Society.

The student was 16 when the relationship started with text messages. Barrett's wife discovered those texts and then confronted the student and her husband. The two admitted they kissed three different times.

Orlando police opened an investigation, but decided Barrett will not face any criminal charges, because the kissing was consensual and there was no groping or any sexual activity.

"It was a simply a kiss or that did not rise to the level of any criminal violation. There is no statute that has been violated," Sgt. Jones said.

The school district said kissing a student does violate school policy. The Department of Children and Families and the school district are currently investigating. Neighbors told Eyewitness News that Barrett packed up and moved to Georgia last weekend.
