Man Loses Part Of Lower Body, Sues Hospital

Posted: 8:51 am EDT June 3, 2009Updated: 10:31 am EDT June 3, 2009

An Orlando man lost part of his lower body to a flesh eating bacteria and now he is blaming Dr. Phillips Hospital. Nelson Mendoza believes he contracted the bacterial infection by walking through dirty storm water in 2004.

Mendoza claims Dr. Phillips Hospital did not diagnose him properly and then did not threat him before the flesh eating bacteria took part of his lower body. Now he is suing the hospital.

"The hospital took a look at me and said, 'Oh, you have a cyst.' Prescribed me some antibiotics, told me, 'You'll be fine in three days. You'll be able to go back to work on Thursday,'" said Mendoza.

Dr. Phillips Hospital is fighting the lawsuit. It claims doctors told Mendoza to return in two days or sooner if the condition got worse, but the hospital says he returned three days later with the infection.
