1,394 Pages Of Docs Released In Casey Anthony Case

He's Casey Anthony's ex-lover, but could the defense try to make him its fall guy? Eyewitness News sorted through 1,394 pages of documents released Thursday in the case against Casey and hundreds of those pages focus on just one man.

Jesse Grund is Casey's ex-fiancé. Over the past year, he's been repeatedly slammed by Casey's family and lawyer.

Grund is on the prosecution's list as a witness in Casey's murder trial. There are 696 pages from the Orlando Police Department about Grund, some painting him as difficult when he doesn't get his way (see Grund docs).

Jesse Grund and his father worry the defense will use the documents to keep trying to create suspicion. Eyewitness News Googled Jesse Grund's name Thursday and found more than 96,000 hits and he's taken hits of his own from Casey Anthony, who told her family not to trust him.

"I think Zanny could either be Amy or Jesse at this point," Cindy Anthony told investigators during an interview.

"Mr. Grund was for all intents and purposes a suspect in this case," Casey's attorney Jose Baez said.

"It hurts," Jesse's father Richard told Eyewitness News on Thursday.

Richard said he's worried the defense will argue Grund was obsessed with Caylee and use the new documents to try to twist his shortcomings into suspicions.

"The one person who, after being told he wasn't Caylee's father, knew he was lied to still wanted to take on that responsibility," Richard said.

WFTV legal analyst Bill Sheaffer wouldn't expect the Anthonys' statements to be admissible at trial and questions what the defense would gain by attacking Grund's credibility; Grund's not the only one who says Casey is a liar, that she was not upset after Caylee's disappearance and that she told many stories about where Caylee was.

"No juror's going to believe that a dozen people in the community or more have conspired to frame this girl," Sheaffer said.

Still, Richard Grund says he wouldn't wish this on anyone.

"You know, if I was a parent watching this story, I'd be thankful it wasn't my son who fell in love with Casey Anthony," he said.

A June FBI letter shows Grund, three other of Casey's ex's and a girl friend agreed to voluntary polygraph tests, which are off-limits to the defense. But Sheaffer says, if the defense is smart, it won't name names, the way OJ Simpson's team didn't.

"They never named a person. They just said it may have been a drug dealer," Sheaffer said.

Sheaffer says the defense should be more concerned with what Lee Anthony has to say. He was questioned under oath Thursday by prosecutors and Sheaffer believes they'd be very interested in hearing more about what Lee told investigators last summer about a conversation with Casey.

"When I asked, um, 'Why won't you, you know, allow us to see Caylee,' she said, 'Well, maybe I'm a spiteful bitch,'" Lee told investigators.

"You don't have to prove motive, but when the defendant hands it to you on a silver platter you don't ignore it. And that's exactly what she did with her statements to Lee," Sheaffer said.

The new documents also confirm that Cindy, George and Lee Anthony are the only ones who were asked by the FBI to take voluntarily polygraph tests who refused. Now, prosecutors are getting their statements under oath (read FBI request).

Also among the information released Thursday were reports of unconfirmed Caylee Anthony sightings (read tips) and interview transcripts with the grandparents, which are not new (George | Cindy).

State attorneys questioned Casey Anthony's brother Lee all day Thursday under oath about the case.

Lee Anthony didn't want to answer questions as he arrived at the State Attorney's Office on Thursday morning. He was inside answering questions all day.

Lee Anthony's attorney says prosecutors want to know what he heard before Casey was charged with her daughter's murder.

Over the two previous days, prosecutors questioned Casey's mom, Cindy Anthony.


WHAT'S NEXT IN THE CASE AGAINST CASEY

Here's what's next in the case against Casey. A status hearing is set for January 21st to determine a possible trial date.

The judge must also consider a possible change of venue. Meanwhile, there's still no trial date for the civil lawsuit she's facing.


STATE DEPOSES CINDY ANTHONY ON WEDNESDAY

Cindy Anthony was questioned under oath again Wednesday by prosecutors in the murder case against her daughter Casey behind closed doors at the State Attorney's Office. Only Eyewitness News was there when the depositions started Tuesday.

Cindy was at the courthouse again with her lawyer, Brad Conway, and Casey's lawyer, Jose Baez, after answering questions for nearly four hours on Tuesday. There are a lot of issues the Anthonys have not been questioned about under oath since Caylee's remains were found down the street from their house in December, including evidence taken from their house that investigators say match evidence found with Caylee in the woods.

When the Anthonys were deposed in the defamation case against Casey, the public saw it on camera hours later, the questions and the answers. Wednesday, there were no cameras at the State Attorney’s Office, so the public will never see what went on.

The Anthonys are clearly in Casey’a camp, teaming up with her defense attorney, Jose Baez, Wednesday for the prosecutors’ deposition, but they are prosecution witnesses.

WFTV legal analyst and former prosecutor Bill Sheaffer said prosecutors would be questioning the Anthonys under oath to determine whether they will be hostile witnesses, legally speaking.

“A witness that is hostile, either to the attorney that has called them to the stand to ask them questions or the interest of the lawyer that has called them to the stand,” Sheaffer explained.

Cindy and George were certainly hostile with the lawyers in the Zenaida Gonzalez defamation case against Casey Anthony, with numerous outbursts recorded on video. Sheaffer says, if the Anthonys dodge prosecutors’ questions, they could ask the judge to declare the Anthonys “hostile.” Then the prosecutors could confront them with their inconsistencies at trial, which could hurt Casey.

“A lying witness doesn’t help the defense,” Sheaffer commented.

Attorney Jose Baez told WFTV reporter Kathi Belich on Wednesday that there has been no hostility so far, agreeing with the characterization that things had been cordial.

Early Wednesday evening, Eyewitness News learned from Lee Anthony’s attorney that he will be deposed Thursday at the State Attorney’s Office. There’s no word on when George will be deposed.


STATE DEPOSES CINDY ANTHONY ON TUESDAY

Cindy Anthony was called to the State Attorney's Office on Tuesday to answer questions in her daughter's murder case and only Eyewitness News was there. Cindy was deposed Tuesday to answer questions under oath.

It has been a long time since Cindy Anthony agreed to answer the questions of people involved in prosecuting her daughter for murder, but Tuesday she was under subpoena to answer.

For some reason, Cindy's deposition was hush-hush. All the others so far were made public through court documents, but Eyewitness News tipped off. Caylee Anthony's grandmother walked into the State Attorney's Office with no fanfare or fiery comments, choosing instead to say nothing.

When she was questioned by investigators two weeks after she reported Caylee missing and said it smelled like a dead body in Casey's car, she completely changed her story.

"I find it very hard to believe that Caylee, Casey had an opportunity to put Caylee in there for a short period of time to get the car stench that bad," Cindy told investigators in August.

Tuesday, months after they stopped communicating with investigators, there were a lot of new questions, some about the evidence taken from the Anthonys' home in December, which investigators say matches evidence found with Caylee's remains.

Eyewitness News asked defense attorney Jose Baez whether he was concerned about Cindy's deposition Tuesday.

"We'll have to see how it goes. Let the state do their thing," Baez said.

Cindy left the courthouse with her attorney after 5:00pm after facing four hours of questioning under oath and made no comment.

"It's an ongoing investigation. There's nothing to hide. Nothing to do. It's part of what the State Attorney's Office does," attorney Brad Conway said. "There's nothing about this case for George and Cindy or Lee, there's nothing easy about it for anybody."

The deposition is not public unless one of the parties asks for a transcript. Then the transcript would be a public record.
