WINTER GARDEN, Fla. -- A stunt led to a huge investigation into Winter Garden's fire chief. A fire marshal says the chief peeked at him while he was in a bathroom stall. Now that marshal told Eyewitness News he may sue if the chief isn't fired.

The incident happened in the fire department headquarters’ men's room. Winter Garden Fire Marshal Tom Anderson says Fire Chief John Williamson looked over the stall and made an inappropriate comment.

“’Hey you want me to watch you wipe your ass?’ I'm standing there half disrobed doing my business naturally,’" explained Anderson.

Anderson was so disturbed that he filed a formal complaint with the city.

"I've asked for his resignation. That's unbecoming of anyone, but certainly a supervisor, a department head," he said.

Anderson called the incident that happened in the bathroom embarrassing and humiliating.

"I felt violated, honestly did," Anderson said.

City Manager Mike Bollhoefer says human resources are handling the situation.

"This is a big issue," Bollhoefer said.

He says that's HR's job so the city is not out manpower or money due to the investigation.

Chief Williamson did write a formal letter of apology to Anderson, but didn't admit to making the comment. The 6-foot-5 chief said his height drew his vision toward movement in the stall and that's why he looked in.

"It wasn't a simple apology, he made it look like it was in relation to something that did not happen," Anderson said.

In a taped interview, Anderson told the city's HR director if Williamson is not forced to resign, he will pursue other action.

"It very well could be something civil against the chief. If I don't feel satisfied with what actions the city takes, I’m going to pursue this further," Anderson said.

The city is still investigating the matter and said it will likely be two more weeks before it will know how Chief Williamson will be disciplined if at all.

Fire Chief John Williamson did not want to comment on the situation, but in the letter of apology he noted the two had had disagreements about the fire marshal's productivity.
