Document Released In Orlando Mayoral Election Fraud Lawsuit
Monday, January 10, 2005
ORLANDO, Fla. -- A previously sealed court document in the election fraud lawsuit against Orlando Mayor Buddy Dyer has now gone public. The mayor's political challenger hopes that it's another piece of evidence he can use in his effort to force a run-off election.
The document is 33 pages and recounts a very brief November court hearing in the ongoing civil case of former candidate Ken Mulvaney versus Dyer. At that hearing, Mulvaney's lawyers wanted to question former Dyer political consultant Ezzie Thomas. But Thomas' attorney, Dean Mosley, successfully argued his client should not be forced to talk."He doesn't come out and say it directly, but his client was more or less paid to go out and solicit absentee ballots, which is illegal," says Mulvaney.Mulvaney says there is no smoking gun in the court paperwork, but he believes Mosley provided one last Friday when he confirmed that his client was paid to collect absentee ballots and that the people who hired Thomas should have known that it was illegal.Dyer was not available for an interview. His lawyer issued a statement regarding the charges, saying, "At no time was any person asked or paid to do anything improper or illegal."But Mulvaney hopes to find proof if his legal team can get to Thomas and confirm that he was paid to go out and solicit absentee ballots in the 2004 election.Exactly when Mulvaney's lawyers will be able to question Thomas is still a little iffy, but it looks like they will be able to question Dyer. His deposition is set for January 19th and the Mulvaney camp hopes it will shed more light on this case. While Mulvaney pursues his civil case, the criminal case is also ongoing. State investigators have already questioned Thomas.
