New Information About 15-Year-Old Student Who Was Shot By Deputy

Channel 9 has uncovered new information about the troubled past of the Seminole County teen who was shot by a SWAT team member after bringing a pellet gun to school.

Christopher Penley, 15, was shot on Friday at Milwee Middle School. He died Sunday from his wounds. Investigators said he took a pellet gun, painted to look like a real gun, to class and then raised it at officers during a brief stand-off.

The funeral service for 15-year-old Chris Penley will be held Thursday afternoon at two o'clock at the Northland Church. His family is grieving, searching for answers.

"My mother's in there. She's still crying all the time," said Ralph Penley, Chris’ brother.

The Penley family has had its problems. Sometimes Chris lived with his dad, sometimes with his mom, and sometimes with both.

The teenager had his problems at school, too. Early last year, he was investigated for making a threat and, this summer, he was suspended for some other reason. He had only returned to Milwee Middle School two weeks ago.

Now the family is searching for answers.

What drove him to such desperation that he would refuse to surrender to a seriously armed SWAT team sniper?

Why would he take a pellet gun to school that was doctored to look like a real one?

Why would he make threats as if he had a real gun?

The sheriff's office has turned over its phone records to the Florida Department of Law Enforcement investigators, records it says proves there were no conversations with Penley's father about whether the gun was real until after the shooting.

Channel 9 was told SWAT team officers put themselves at risk, breaking cover at times to protect the other students. But once Penley raised what looked like a semi-automatic weapon, that's where the rampage had to end.

Attorney Mark Nation, who is helping the family through this, said he's gotten e-mails from all over the country, from people who support what deputies did and people who don't.

Tuesday afternoon there may be more details, after FDLE investigators brief the sheriff's office and school district on what they've found out so far.
