Charges dropped against suspect in fatal 2009 DUI crash

MARION COUNTY, Fla. - Prosecutors have dropped charges against a Marion County man who was set to stand trial in a DUI manslaughter case because there wasn't enough evidence to prove he was driving.

In October 2009, troopers said Anthony Quirello, the victim and possibly another man were in a car when it struck a pole and crashed into a tree, killing one of the passengers.

Quirello wasn't arrested until three years later in 2012, but maintained he wasn’t the one driving.

Investigators could only find Quirello's DNA on the car's door handle and a witness retracted her statement that she saw Quirello driving the car that night.
