Mother gets custody of baby who was thrown from balcony

OSCEOLA COUNTY, Fla. — An emergency custody hearing was held Wednesday for a 2-year-old boy who was thrown from a second floor balcony.

Police said the baby was thrown by his father Juan Pablo Maradiaga, just before Maradiaga jumped from the same balcony.

The Department of Children and Families asked a judge to strip Maradiaga of his parental rights at the Osceola County hearing.

"There’s probable cause to believe the father has abused the child,” the judge said in court.

As a result, a judge ruled the baby can stay with his mother.

"Visitation shall remain unsupervised, as far as the mother.  As to father, the father shall have no contact with the child,” said the judge.

The baby's mother said she is emotionally drained and that the child, who suffered broken bones, is doing well.

"He’s fine and it’s like an angel, holding and I don’t have nothing else to say,” said the child's mother as she left court.

Maradiaga, 41, was arrested and charged with attempted murder after last week's incident.
