Osceola man accused of raping mentally handicapped girl

OSCEOLA COUNTY, Fla. — A man who was once jailed on sexual battery charges is back in jail for the same thing, investigators said.

The Osceola County Sheriff's Office said 23-year-old Henry Alban is behind bars facing sexually battery charges after investigators said he raped a young girl.

"He went into the residence and took her clothes off and sexually battered her," Twis Lizasuain said. "She's 16 years old but it does appear she has a diminished mental capacity."

Detectives said Alban was a friend of the family and was supposed to be taking the victim to school when the attack happened.

After the assault, the girl called her mother who then called the Sheriff's Office.

This isn't the first time the suspect has been behind bars. In 2009, he was arrested for similar charges.

Back then he faced a laundry list of charges after Kissimmee police said he targeted another girl with diminished mental capacity.

They said he climbed into the 13-year-old's bedroom window and assaulted her as well.

He went to trial for the crime, but was only convicted of a misdemeanor and only served 60 days in the county jail.

Because of the lesser offense, "he was not listed as a sex offender," Lizasuain said .

No one at the home wanted to comment.
