Caylee was last seen alive on June 16, 2008, but Casey never told anyone Caylee was gone until a month later when her mother demanded answers. Why she said nothing is one of the first questions the 911 operator asked her, that investigators asked her, and it's one of the first questions the jury will want an answer to.
Almost three years later, we still haven't heard it.
caseypartypics06 PARTY PICS:See 'Party Girl' Casey Casey's lawyers are trying everything to prevent the jury from hearing what she was up to the first 31 days Caylee was gone. They've filed yet another motion trying to keep the jury from seeing Casey's party and hot body contest pictures and from hearing about how she spent her days and nights during those 31 days.
"They've gone through the front door to try to keep it out. They've gone through the back door to try to keep it out. Now they're climbing through the windows to try to keep the evidence out," WFTV legal expert Bill Sheaffer explained to WFTV reporter Kathi Belich.
The defense claims prosecutors cannot use that evidence to prove Casey's consciousness of guilt, because it doesn't show she was evading prosecution by fleeing, destroying evidence or covering it up.
Sheaffer disagrees.
"Isn't that an element of concealment to act as though nothing is wrong?" he questioned.
Casey claimed her daughter disappeared with the nanny and that she was conducting her own investigation, but not one person told investigators Casey asked about Caylee. To the contrary, Casey claimed she was fine and with the nanny.
Sheaffer says prosecutors can use the evidence to show Casey's actions were inconsistent with her story. They say she murdered her daughter, hid the body in her trunk, and then discarded it in the woods near their house.
"That's relevant evidence for the state to prove their charge," Sheaffer said.
The trial is two weeks away. Chief Judge Belvin Perry has set aside time for last minutes on issues like this, but at this point nothing's been scheduled.
