ORLANDO, Fla. —
A Brevard County Veteran is alive and well. But 4 times now the government decided he's dead, then cancelled his veteran's benefits. Friends are calling Jerry Miller dead man walking. According to the Department of Veterans Affairs the Vietnam vet had died and it notified his wife Agnes that his benefits were terminated.
(Todd Ulrich) "You look pretty darn good for a dead guy." (Jerry Miller) " Yeah yeah, I do.."(laughs)
It's not the first time. Four times in the past two years the agency sent a letter to the estate of Jerry Miller Because he's deceased the VA checks would stop. The same notification went to Social Security. "It isn't funny to me. I got a mortgage payment to make I could lose my house, " said Jerry.
Each time his wife called the VA to plead her case. "I said he's not dead, he's right here, she's says well let me talk to him." The first 3 times, Agnes was able to convince the agency it was a mistake and weeks later Jerry's benefits were restored. When a 4th death notice arrived this month he contacted Action 9 the veteran was tired of constantly fighting for benefits he earned 30 years ago. We tracked down administrators at the VA in Washington who said Jerry's death was included in a database by mistake last year. The error has now been corrected, he will receive all the benefits he's owed.
In one letter the VA also demanded the family return benefits paid after Jerry had died. That is now under review.
