PALM BAY, Fla. —
A Brevard County judge laid into one of the three Palm Bay teens accused of bullying an autistic student on video.
We were the first to show you a video of the incident. The three teenagers have all been charged with a hate crime. All three teens could walk out of jail Friday night.
Judge Charles Roberts dressed down Joeleon Abel after the teen was accused of aggravated stalking and a hate crime.
"You should be ashamed to be standing here in front of your parents. In front of people from your church," Roberts said.
The teen's silence was quite the contrast from the video that landed him back in the juvenile justice system.
Abel and two others are accused of harassing and bullying an autistic student at a bus stop in Palm Bay.
Police said the incident was elevated to a hate crime after they called the student a "cracker."
Prosecutors asked the judge to hold them for a week while they decide if they will formally file hate-crime charges and whether they will be tried as adults.
The public defender asked that Deon Glispy be released so he could attend a basketball game.
"He's indicated to me that if he misses two games, he's kicked off the team, and your honor, we believe this is a wonderful activity for him to be involved with," the public defender said.
The judge ordered Glispy to home detention, with no games. The judge ordered Glipsy and Abel be fitted for ankle monitors until their next hearing.
"I'm going to trust you, and you better earn that trust. Do you understand me?" the judge said. "Because if you don't I promise you I will put you back in jail."
The third defendant, Tyjuan English, is already on home detention.
A judge will review their case again next Friday.
