APOPKA, Fla. —

Craig Kerry is no stranger to the legal system.

He served eight years for false imprisonment and sexually assaulting a child and is facing similar charges for what Apopka police say he did to a young woman behind a Circle K dumpster Saturday.

The 46-year-old man is charged with kidnapping, resisting an officer without violence, sexual assault of a victim over the age of 12 and battery.

A witness who didn't want to be identified said she saw the commotion and the woman Kerry is accused of trying to rape.

"She looked like she was terrified, her knees and legs were pretty scraped up," said the witness.

Kerry was talking to the victim outside the store when he threw her over his shoulder and took her behind the dumpster and tried to rip her clothes off, according to a report.

A clerk putting out the garbage stepped in.

"He said he walked outside and heard somebody screaming, looked behind the dumpster and seen a guy on top of a girl and grabbed him and jerked him off," the witness said.

Eyewitness News learned Kerry could have been getting further treatment after being released from prison and labeled a sex offender.

Kerry's name is on a Department of Children and Families list of people reviewed for Florida's sexually violent predator program through the Jimmy Ryce Act.

Those people can be committed for further treatment because it's believed they might offend again, Kerry was recommended for release.

"I'm very disgusted," said the witness. "It could have been me, it could have been anyone on the street.
