ORLANDO, Fla. —

The trial of the man accused of shooting Danielle Sampson, 15, may take an unusual turn Monday.

Sampson was shot when the van she was riding in was caught in the middle of a shootout in Pine Hills last July.

Tyrone Mosby, 20, was arrested on an attempted murder charge.

Because Sampson’s father is out of the country due to a death in their family, the judge may possibly pick a jury this week and then wait at least another week to start the trial in order to give Sampson’s father time to return.

Her father is one of the state's main witnesses. He was driving the van when the shooting happened.

Detectives said Mosby and a group of other men had just burglarized a home and were firing shots at the homeowner who was chasing them.

A stray bullet tore through the van's window, hitting Sampson in the head.

She has not recovered from the traumatic brain injury.

Mosby's father told WFTV his son is sorry about what happened.

"He does have remorse. I pray for the little girl every night that she gets better.  I hope she gets better. But I can't say who did it," Tyrone Mosby Sr. said.
