OFFICIAL SWEEPSTAKES RULES
- NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
- ELIGIBILITY: The 2004 Summer Splash Sweepstakes is open to residents of the State of Florida who are eighteen (18) years of age or older at time of entry. Eligibility to win a Spa from N.S.P.I. is limited to entrants who are resident homeowners of Orange, Lake, Osceola or Seminole counties. All other prizes are open to residents of any county in Florida. Employees of WFTV, Inc., N.S.P.I Members, Stein Mart, Dales Seasoning, Dolly Parton's Dixie Stampede, Wet N Wild, Emerald Coast RV Center, Daytona Beach CVB and each of their respective affiliated companies, and advertising and promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees, are not eligible to enter or to win. The term "immediate family members" includes spouses, parents, grandparents, siblings, children, and grandchildren.
- HOW TO ENTER: The Sweepstakes will begin at 5:00 p.m. (E.S.T.) on June 7, 2004 and all entries for Grand Prize drawings must be received by 5:30 p.m. (E.S.T.) on August 31, 2004. There are four ways eligible participants can enter to win. Internet Entry: Enter by visiting the official registration page on www.wftv.com and www.icFlorida.com and completing all of the required information and following all instructions. Submit your entry by clicking on the "SEND" button. Mail Entry: To enter, complete an Official Entry Form available at available from June 7, 2004 until August 31, 2004, at participating "2004 Summer Splash Sweepstakes" retail locations while supplies last, including participating Central Florida Stein Mart locations, Emerald Coast RV Center and participating N.S.P.I. Members. You can also enter by writing your name, address, birth date, and phone number on a 3"x5" card. All official entry forms and 3"x 5" card entries must be mailed in a standard size envelope with first-class postage affixed to: WFTV "2004 SUMMER SPLASH SWEEPSTAKES," P.O. Box 999, Orlando, FL, 32802. In Person Entry : Entries will also be acceptable if submitted to WFTV's "SUMMER SPLASH SWEEPSTAKES" Prize Patrol personnel or hand delivered to WFTV-9 studios. Enter as often as you like provided that multiple entries by means of software generated or other automated processes will be disregarded, but only one (1) prize per person. No facsimiles or mechanical reproductions permitted. Only one entry per outer stamped envelope. All entries must be postmarked by August 31, 2004 and received no later than September 3, 2004. Sponsor will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. All entries become property of Sponsor and none will be returned. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the email account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Sweepstakes.
- Winner Selection: Four (6 Grand Prize Winners will be selected in a random drawing from among all eligible entries received by the entry deadline to be held on or about September 4, 2004.
- Prizes and Odds. First Grand Prize: One (1) First Grand Winner will be receive a Garden Leisure Magnolia model Spa from N.S.P.I. (ARV Spa:$5,000). The award of a Spa from N.S.P.I. is subject to and conditioned upon: (1) all laws and regulations that govern the presence of a spa on Winner's property; (2) proof of residency and ownership of property in Orange, Lake, Osceola or Seminole counties; (3) adequate electric hook-up for the Spa (220 electric hook up is required); and (4) an installation area clear of encumbrances and sufficient to install the Spa. Failure of Spa Winner to meet any of these requirements will result in his/her forfeiture of the prize. All decisions by N.S.P.I. in determining if the potential spa winner's property is suitable for a Spa are final. Second Grand Prize: One (1) Second Grand Winner will receive a $1,000 gift certificate for a shopping spree at Stein Mart. Third Grand Prize: One (1) Third Grand Prize Winner will be randomly selected to receive a Family Party Pack that includes six tickets to Dolly Parton's Dixie Stampede Dinner & Show in Orlando, Florida. (ARV $264). Fourth Grand Prize: One (1) Fourth Grand Prize Winner will be randomly selected to receive four (4) Annual Passes to Wet 'n Wild (ARV $356). Fifth Grand Prize: One (1) Fifth Grand Prize Winner will be randomly selected to receive a Daytona Beach CVB Gift Package that includes a four day/three night stay for four at The Bahama House, four passes to Sun Cruz Casino, Four passes to the Museum of Arts & Sciences, Four passes for Trolley Boats, Meal for four at Bubba Gump's, four movie passes to R/C Theaters at Ocean Walk and two Daytona CVB caps, T-shirts, pins and beach balls (ARV $400). Sixth Grand Prize: One (1) Sixth Grand Prize Winner will be randomly selected to receive from Emerald Coast RV- two La Fuma recliners, one Olympia L.P. grill, two Rome's pie irons, one Roto shiskabob grill set, one BBQ tool set, one Adam's folding table, and oneGood Sam's Camping Kit: Coast to Coast 3 day/ 2 night accommodation at a Good Sam's Resort for Two, one year membership to MotorHome or Trailer Life Magazine, one year membership to Camping World Presidents Club and Good Sam's Club. (ARV $590). All incidental expenses associated with prizes not specifically described above shall be the sole responsibility of the winner and of his or her travel companions and guests. All prizes are non-assignable and nontransferable. No cash equivalents or substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes or prize components of equal or greater value. Winners are solely responsible for reporting and payment of all taxes on prizes. Prize may be subject to blackout periods, and other restrictions may apply. Odds of winning depend on the number of eligible entries received. Sweepstakes may be presented in multiple presentations and in other media, and the odds of winning may depend on the number of eligible participants who enter the Sweepstakes through such multiple presentations.
- Winner Notification and Acceptance: Winners will be notified by telephone on or about September 5, 2004. Sponsor will call only once during regular business hours at number provided on entry form and will leave no messages. Failure to reach winner during this call may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of a substitute winner from among all remaining eligible entries. Winners will be required to visit WFTV, located at 490 E. South St., Orlando, FL 32801, in person, during regular business hours within twenty-one (21) days of being notified to claim prizes by providing proof of eligibility for prize won and completing and signing an affidavit of eligibility and a liability and publicity release (except where prohibited by law). Failure of any Winner to timely visit WFTV in person and sign and return any required affidavit and release, or to claim a prize or comply with any term or condition of these Official Rules, will result in drawing Winner's disqualification and the forfeiture of his or her interest in the prize. Winners may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Failure to sign and return the affidavit, or to comply with any term or condition of these Official Rules, may result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Except where prohibited, acceptance of any prize constitutes winner's consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation the Internet, or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor(s). - Participation: By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes judges. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Sponsor. In the event the Sweepstakes is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes. Should the Sweepstakes be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.
- Construction: The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
- Sponsor: The WFTV "2004 SUMMER SPLASH SWEEPSTAKES" (the "Sweepstakes") is sponsored by WFTV, Inc. ("WFTV") ("Sponsor"), whose decisions regarding all aspects of the Sweepstakes shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Sweepstakes.
