Police: Man plots revenge, then beats and rapes relative

VOLUSIA COUNTY, Fla. — Police said a Volusia County woman is lucky to be alive following a beating and rape by one of her relatives.

According to the police report, James Smith attacked a member of his own family after planning a revenge plot for several days.

The police report shows Smith told the victim he was getting revenge for how she ripped his father off on property in Kentucky.

Police said Smith handcuffed the victim and then violently raped and beat her. Authorities said Smith even held a gun to the victim and made her take prescription pills.

According to the police report, the doorbell happened to ring, and the victim was able to flee the residence with the assistance of a UPS employee who called 911.

"I was just delivering to the house right now, she came out saying, 'Please help me, please help me,'" the good Samaritan told 911 dispatchers. "She's all beat up in the face. She's got a bloody lip, a black eye."

Police said the beating was so bad that the victim had several broken bones in her face.

"She's crying, um…she…he did what? He drugged you? OK," the man can be heard saying to dispatchers.

Police said Smith fled and took a cab from a nearby store to the Streamline Hotel, but they tracked him down and arrested him.

Smith is charged with aggravated sexual battery, false imprisonment, possession of a controlled substance and violation of probation. He's being held without bond.
