Police: Ocoee mom drank two bottles of wine, crashed car with 6-year-old inside

OCOEE, Fla. — An Ocoee mother has been charged with felony child neglect after she crashed her car into a ditch with her 6-year-old in tow.

Ocoee police arrested the mother of two Wednesday at 2 a.m. after they said she took her 6-year-old on a wild ride.

According to the police report, Elizabeth Farias took a wrong turn down Clark Road, which happened to be a dead end. Authorities found the car after it crashed into a ditch.

Officers said Farias had just come from a friend's house where she drank two bottles of wine and then got behind the wheel.

Police said Farias admitted she had been drinking but they couldn't charge her with DUI because the officer didn't see her driving, holding the keys or sitting in the car.

Farias is facing felony child neglect charges.

Farias spent the last two days behind bars at the Orange County Jail before her brother bailed her out Thursday night.

While no one was hurt in the crash, Farias' brother, Raul Maldonado, said it could have been a lot worse.

"(I'm) very angry. I mean, she should have got a friend to drive her home," Maldonado said.

A legal analyst said if an officer didn't see her driving, holding the keys or sitting in the car, he can't make a DUI case and said misdemeanor charges are more difficult to prove, even with an admission.

"This is her first time, and we'll talk with her, try to give her help and all the support she needs. She'll be hurting inside, just like we are," Maldonado said.

Farias' daughter is in the care of her father.  The Department of Children and Families is investigating.
