BOISE, Idaho — Lori Vallow Daybell who allegedly killed her kids in Idaho is seeking to change her charges.

According to The Associated Press, on Tuesday during a hearing, Lori Vallow Daybell’s attorneys asked a judge to send her case back to a grand jury to help clarify the indictment.

Both Lori and her husband, Chad Daybell, have pleaded not guilty to murder, conspiracy and grand theft charges for their alleged involvement in the deaths of Lori’s children, Joshua “JJ” Vallow and Tylee Ryan, 17. If Lori and Chad are convicted, according to the AP, both of them could face the death penalty.

Lori’s attorney during the hearing said the conspiracy charges were “oddly constructed and likely to confuse a jury,” according to the AP. One of the conspiracy charges was said to be because the couple allegedly planned to kill Tylee because they wanted to steal the social security benefits that she received after her father’s death. Similar allegations were made with JJ. Lori’s attorneys want the charges to be “tweaked” after the case is returned to the grand jury.

Judge Steven Boyce during the hearing said he would consider the argument about sending the case back to the grand jury and would later make a decision, according to the AP.

The case started in November 2019 after extended family members reported that JJ and Tylee were missing to Idaho law enforcement. Lori and Chad had both allegedly lied about where the kids were but both were ultimately found buried on Chad’s property, according to the AP.

Lori has also been charged with conspiracy to commit murder in Chandler, Arizona for the death of her last husband, Charles Vallow. This case is on hold as the Idaho case is being presented, according to the AP. Vallow was shot by Lori’s brother, Alex Cox, who told police it was “self-defense.” Vallow died from his injuries. Cox died from “natural causes.”
