Homeowner Shoots Intruders In Bedroom

POLK CO., Fla. — A Polk County man shot two teenagers after waking up to find them inside his house Tuesday afternoon.

"We all know that your home is your castle. If there's any place in the world you should be safe, it's at home," said Sheriff Grady Judd, Polk County.

Jose Luis Oyola-Aponte, and his wife, Yahaira Cintron-Rivera were sleeping in their Davenport home when they heard a crash.

They opened their eyes and rolled over to see a masked man standing in their bedroom.

Jose Luis Oyola-Aponte grabbed his handgun and started shooting. The intruder in the bedroom was shot in the head. A second intruder climbing in through the window was hit in the torso.

Both suspects tried to run, but were caught quickly and rushed to the hospital.

The two intruders were just 15 and 16 years old. Outside the house were two other teens, ages 15 and 17, waiting to collect the loot their friends grabbed.

The homeowners will not be charged for the shooting. Deputies said they did nothing wrong, even though it appears the intruders were not armed.

"When you're woken from a dead sleep with a masked intruder, you don't have time to ask how old are you, and are you dangerous. Because as victims if you do that, you'll be a dead victim," said Judd.

As part of standard procedure, deputies searched the victim's home, and found drugs. They arrested Jose Luis Oyola-Aponte on drug charges.

The intruder who was shot in the head was in critical condition Tuesday night. The second intruder was in stable condition.
