ORLANDO, Fla. — The excessive-force trial of a former Orlando police officer continued Thursday.
Robert Liese is suing Peter Delio, who was caught on camera beating Liese inside a jail cell.
Liese was also suing the city of Orlando for the incident.
But a judge said Thursday that he did not find enough evidence that the Orlando Police Department didn’t properly train its officers in excessive force.
The case will move forward, but only against Delio and not the city of Orlando.
Liese's lawyer told the jury the video clearly shows that after Liese, who was handcuffed behind his back, head-butted the cell window, Delio rushed in and beat him.
“I think the important thing to remember is that former Officer Delio was disciplined for the excessive force and he was terminated,” Orlando Police Chief John Mina said.
A surgeon testified in court Wednesday that Liese’s internal bleeding was fresh blood that wasn’t clotted, and Liese’s spleen injury was recent when he got the hospital.
Delio's attorney said Liese admitted on the stand Thursday that he raised $236,000 for his medical bill on a Go Fund Me page to gain sympathy and money, even though it didn't work.
Delio's attorney also is arguing that Liese's spleen injury was not caused by the knee strike, but instead by some previous, unknown injury.
Liese had asked for medical attention for an hour and a half before paramedics were called, attorneys said.
WFTV legal analyst Bill Sheaffer said Delio's house could not be taken and he could also file for bankruptcy if he's ordered to pay Liese damages.
"It's just a very longshot that this plaintiff will ever see a dime of that," said Sheaffer.
