Volusia County deputies shoot man, 28, accused of driving toward them

VOLUSIA COUNTY, Fla. — A 28-year-old Paisley man accused of carjacking several people in Volusia County after getting into an argument with his boyfriend was shot four times after driving one of the stolen vehicles toward deputies, Sheriff Mike Chitwood said.

Justin Kaegael had gotten into an argument with his boyfriend Tuesday and tried to drive off in his car, dragging him along the road until he crashed on Euclid Avenue in DeLand, deputies said.

The incident happened at Discount Market in the area of Euclid and Spring Garden avenues in Deland just after 4 p.m., investigators said.

When two good Samaritans stopped to help the victim, Kaegael jumped into their car and took off, Chitwood said.

"The owner of a red Saturn pulls up as a good Samaritan to give help," he said. "The bad guy then jumps into his car and takes off."

The victim received non-life-threatening injuries, the Volusia County Sheriff's Office said.

Deputies put down stop sticks as Kaegael drove east on Interstate 4 near Daytona Beach, but Kaegael drove over them and continued driving, investigators said.

Kaegael made it to Bellevue Avenue in Daytona Beach, where he allegedly forced another driver out of his truck, deputies said.

Kaegael is accused of driving the truck toward Deputy David Teske, 33, and Deputy Bryan Luoma, 48, who shot him in the neck, shoulder, arm and leg, Chitwood said. The suspect wasn't armed.

Teske was hired in 2013. Luoma has been with the agency since 2003.

The deputies have been placed on paid administrative leave while the Florida Department of Law Enforcement investigates the shooting, which is typical.

"If he doesn't put the vehicle in drive and come out of there at them, he doesn't get shot," Chitwood said. "For whatever reason, he went on a tear for who knows why."

Records said Kaegael was on probation after a 2015 arrest in Lake County for theft, resisting arrest and identity fraud.

Tuesday's shooting was the agency's fifth deputy-involved shooting this year and the second in less than a month.

Brodie Hughes, president of Volusia County Deputies Association told Channel 9's Mike Springer that the agency averages about a dozen officer-involved shootings a year.

"If you shoot at us, we are going to shoot back and we are pretty good at shooting back," Hughes said.

A union representative goes to an officer-involved shooting to provide counseling and legal aid for the deputies involved.

"I have been to scenes where deputies, they handle it like a deer in the headlights because it is probably one of the most daunting things you will do as a law enforcement officer," Hughes said.

Hughes said he believes the uptick in deputy-involved shootings is due to encountering more people with mental health issues and people more willing to challenge police with deadly force.

Kaegael was charged with two counts of carjacking, and one count each of kidnapping, and grand theft of a motor vehicle. Additional charges are pending, deputies said.

Kaegael is in the hospital. It's unclear how much is medical care will cost taxpayers.
