OSCEOLA COUNTY, Fla. — An inmate who escaped from the Osceola County jail, then spent three months on the run, tried Friday to fight his 22-year sentence.
Michael Rigby represented himself, with his attorney as his co-counsel.
Prosecutors argued Rigby is still a danger to the community.
“Mr. Rigby envisioned my own death, certain conspiracy theories in regards to the judge and the state attorney’s office, the court,” said prosecutor Robert Holborn.
Holborn said in court that Rigby personally threatened him in August by saying the prosecutor was possessed with demons.
Rigby’s 22-year sentence conviction for his 2010 escape from the Osceola County jail was overturned by the 5th District Court, which ruled Rigby’s enhanced sentence for being classified as a habitual felony offender was not correct because he only had one felony on his record.
He could, however, be sentenced as a habitual violent felony offender, which also has an enhanced sentence.
“The state today corrected the enhancement,” Holborn said.
Rigby told the judge that he sometimes does things he later regrets.
Rigby can appeal his sentence.
