Family of woman hit, killed by SUV unhappy with lack of charges

PORT ORANGE, Fla. — Leona Daniluk, a mother and grandmother, was hit and killed in April while crossing the road at White Street and Ridgewood Avenue in Port Orange.

Channel 9's Lori Brown learned the driver who hit Daniluk was issued a traffic citation that carries a $64 fine and that the punishment feels like an insult to Daniluk's family.

Daniluk, 78, had just been to a doctor's appointment and was crossing the street in an unmarked crosswalk to get breakfast at a restaurant on Ridgewood Avenue when a Porsche SUV driven by Nicole Nagrani, 21, stuck her. The incident was caught on surveillance video.

The Port Orange police report said the lack of skid marks shows Nagrani didn't try to stop or swerve to avoid hitting Daniluk.

Nagrani's attorney told police Nagrani was not on her cellphone but that "the phone had fallen and she was attempting to retrieve it."

Daniluk's daughter, Tina Melnicoff, said she's frustrated that the driver is not facing criminal charges, not even a misdemeanor charge, for hitting and killing her mother.

"It seems like a slap on the wrist," said Melnicoff. "It makes me very angry, very hurtful. It's been hard these past four months without my mom."

Police believe the Nagrani was driving under the speed limit at the time of the accident and her attorney said she should not be facing any charges, but did not want to elaborate as to why.
