Former Lynx driver accused of groping passenger back in court

ORANGE COUNTY, Fla. — A former Lynx bus driver, accused of assaulting a disabled passenger, was back in an Orange County courtroom Monday.
 
Gustavo Riano was arrested more than five years ago for allegedly groping and kidnapping Ermelinda Bonilla while she was strapped to a seat in a Access Lynx bus.
 
Investigators said Riano admitted to it and nearly took a plea deal, but for the last four years, he's been found to be incompetent to participate in his defense.

On Monday, a judge ordered another evaluation, and if a doctor finds Riano's competency cannot be restored by January 2016, after five years of trying, the case could be dropped.
 
Bonilla claims that in 2010, Riano, who transported disabled passengers, drove off of his usual route and groped her while she was strapped in and helpless to move.
 
Bonilla's husband said he was tormented for hours while Riano held his wife hostage in the bus and texted him throughout the ordeal.
    
"It was the most horrifying day of my life. I was thinking I can do all kinds of things, but I can't help her," Fred Bonilla said.
 
Since that incident, Riano's attorney has been fighting the case, claiming his client is incompetent to stand trial.
 
The doctor's conclusions on Riano's competency are expected to be available in a couple of months.
