ORANGE COUNTY, Fla. — An Orange County deputy is under investigation and on desk duty after video surfaced of him allegedly kicking a handcuffed suspect in the head.
Channel 9 learned it’s the second time in two months that Deputy Richard Nye was accused of using excessive force.
According to the Sheriff’s Office report about the incident last Saturday, Sammy Mike was trying to get away from a deputy who was following him.

The deputy was trying to pull over Mike, who was suspected of stealing a car and cocaine possession.
The report said Mike lost control of the car and hit another vehicle.
Mike allegedly tried to run from the scene but eventually stopped at Nye’s commands.
Nye wrote in the report that Mike said, “OK, I’ll get down” and did.
Channel 9 obtained cellphone video of the scene from a passerby.
The video shows another deputy pointing a weapon at Mike, while the suspect was on the ground being handcuffed.
But it’s what happens seconds later that has the Sheriff’s Office opening an investigation.
While the deputy, who was pointing the weapon, walks away, Nye appears to look around and then kick the suspect, who was handcuffed and lying face down on the ground.
Nye's report said, "Using minimal force, I had to roll him onto his side so he could be checked for weapons."
Cellphone video also caught another incident that led to an investigation into Nye’s use of force.
The video from July at the Retreat Apartments allegedly shows Nye on top of a woman while she’s yelling. She claims he dislocated her shoulder.
Nye and another deputy are under two investigations related to the incident.
Mike has not filed a complaint and is still in jail.
When Channel 9 showed the video to the Sheriff’s Office, it was handed over for an internal investigation.
Mike was charged with resisting an officer without violence. Nye is still on the job.
