A lawsuit against Brevard County and former Brevard County Fire Rescue paramedic Kenneth Hallenbeck that was filed last month, has been dismissed, Channel 9 found out Monday.
The lawsuit stems from an incident in February 2015, where James Slater, 50, was flipped onto a floor at Weusthoff Medical Center in Rockledge.
“I don't know how it all happened. He seemed very angry, and I've never been treated that way in my life,” said Slater.
Hallenbeck was fired and pleaded no contest to a misdemeanor charge of culpable negligence. He received a year of probation and surrendered his license.
Slater sued the county and Hallenbeck for about $15,000 in damages.
“I was recovering from surgery on my shoulder, and as a result of him throwing me on the floor, I had to have surgery again,” Slater said.
Slater's attorney, Derrick Connell, told Channel 9 on Monday that the civil case was resolved amicably between the parties.
The details of that tentative settlement are confidential.
Slater's attorney said his client's health issues also played a role in the settlement.
They wanted to avoid prolonged litigation.
