PALM BAY, Fla. — A Brevard County grand jury handed down indictments in three murder cases Wednesday.
The state may not try to get Jessica McCarty sentenced to death in the killing of her three children.

She’s accused of killing her three children; 5-month-old Christopher Swist, Phillip McCarty, 6, and Lacey McCarty, 7.
Jessica McCarty was charged with three counts of first-degree pre-meditated murder.
The grand jury heard testimony from the Brevard County associative medical examiner, three Brevard County Crime Scene Investigators and a Palm Bay police detective before returning the indictment.
Investigators said McCarty’s children were strangled inside their Palm Bay home on Kenmore Street home last month.
McCarty, who has a history of mental health issue, made the call to 911.
“At this point, it’s a death penalty case. It involved the death of three innocent children,” said Assistant State Attorney Michael Hunt.
