Driver bonds out, admits to being over legal limit in crash that killed man

ORLANDO, Fla. — A man who admitted to hitting and killing a 19-year-old man on the 408 Expressway in Orlando posted bail and is out of jail, according to authorities.

Investigators said Thomas Monks admitted to them that he had been drinking and doing drugs before the crash late Saturday night.

WFTV went to Monks' home Monday night.

"Thomas Monks? We are here to ask you what happened the other night on 408," WFTV reporter Drew Petrimoulx asked.

Initially, Monks was not happy to see WFTV's camera at his door, but after an angry reception, he decided he would talk.

"I already told the cops what happened," Monks said.

"Were you drunk?" Petrimoulx asked.

"I was over the legal limit," he replied.

At about 11:15 p.m. Saturday, Monks said he was driving westbound on the 408 Expressway and Hiawassee Road when he hit and killed Malcolm Davis, who was standing beside his disabled vehicle.

"How much had you had to drink?" Petrimoulx asked.

"I probably drank 10 beers like all day from ..." he said.

"For 10 hours?" Petrimoulx asked.

"No," Monks asked then slammed the door.

Troopers said they could smell alcohol on Monks and that his eyes were bloodshot and his speech was slurred.

A Breathalyzer registered his blood-alcohol level over the legal limit, and investigators said they found a marijuana pipe in his car.

Investigators said Monks admitted he'd been smoking marijuana as well.

"Other than premeditated first-degree murder, the law favors setting a bond in the case. The defendant is entitled to bond and release, pending trial," said WFTV legal analyst Bill Sheaffer.

WFTV checked Monk's criminal record and found multiple drug-related arrests, including being sentenced to probation for dealing marijuana 12 years ago.
