Prosecutors want man accused in fatal road rage shooting back in jail

Prosecutors are headed to court this week to try and put Robert Gelles back behind bars.

They say Gelles, 63, shot and killed Joseph Bailey III along U.S. 1 in Port Orange two weeks ago during a road rage incident.

"He's out for $10,000 after he had shot my son, and we couldn't believe it," Joseph Bailey II said.

Police say Bailey III and Gelles were racing and cutting one another off in traffic before Gelles ran into Bailey III's truck near Dunlawton Avenue.

Gelles shot Bailey III as Bailey III got out of his vehicle and approached him, investigators said.

"How do you account for a guy that has enough rage, a 63-year-old man, enough rage in him to kill somebody outright,?" Bailey II said.

Officials with the State Attorney's Office said they already asked that Gelles be held on a no-bond status. A judge granted Gelles a $100,000 bond for his second-degree murder charge.

Court officials say Gelles' past factored into the decision. Gelles was sentenced to one year of probation in 2009 for allegedly pulling a gun on a family.

Prosecutors said Gelles is a threat to the community, and there is no way to prevent him from harming someone else.

Bailey's family members said they are concerned for their safety, too.

"Even though he's 25 miles away, he's way too close to us, as far as we're concerned," Bailey II said.

Prosecutors will be back in front of a judge Wednesday, asking for Gelles to be returned to jail.
