17 businesses accused of selling alcohol, nicotine to underage customer

VOLUSIA COUNTY, Fla. — An investigation revealed that 17 businesses in Volusia County sold alcohol and nicotine products to an undercover underage customer, the Volusia County Sheriff’s Office said.

The operation took place from Jan. 21 to Feb. 9.

An underage person was able to make 16 purchases of tobacco or nicotine vape products and 5 purchases of alcoholic beverages, the sheriff’s office said.

In October 2021, Florida implemented new legislation raising the minimum age to purchase tobacco and nicotine products from 18 to 21 years of age, the same as alcohol.

The Volusia County Sheriff’s Office said the violations are misdemeanors.

The store locations are being shared with the Florida Division of Alcoholic Beverages and Tobacco for administrative review.

According to the sheriff’s office, the following stores are facing violations:

• NSB Vapor Parlor at 201 South Ridgewood Avenue, Edgewater.
• NSB Vapor Parlor at 638 East 3rd Avenue, New Smyrna Beach.
• AK Food Store at 727 Canal Street, New Smyrna Beach.
• Pumpernickel Pops Smoke and Vape Shop at 2841 South Nova Road, South Daytona.
• Bengals Discount Liquor at 335 Beville Road, South Daytona.
• Jaguar Smoke and Vape Inc. III at 700 Ridgewood Avenue, Holly Hill.
• Speedy Mart at 949 Center Avenue, Holly Hill.
• Shell at 201 West Granada Boulevard, Ormond Beach.
• Volusia Smoke and Vape City at 1428 North Woodland Boulevard, DeLand.
• Omi’s Phone Store/My Fuel at 301 South Woodland Boulevard, DeLand.
• Smoke Em II at 871 South Charles R. Beall Boulevard, DeBary.
• Smokeless America (River City Smoke & Vape) at 98 South Charles R. Beall Boulevard, DeBary.
• Orange City Liquor at 1155 North Volusia Avenue, Orange City.
• Orange City Smoke Shop at 951 North Volusia Avenue, Orange City.
• Luxe Smoke & Vape at 485 North Volusia Avenue, Orange City.
• Johny’s Rotten Tobacco & Smoking at 2540 N. Volusia Avenue, Orange City.
• The Friendly Way at 901 South Florida Avenue, DeLand.
