Are Red Light Cameras Unconstitutional?

CENTRAL FLORIDA,None — Red light cameras are being used across Central Florida to catch red light runners who cause accidents, but a south Florida judge ruled Tuesday that red light camera fines are unconstitutional because an officer has to witness the violation.

Now, state lawmakers may have the final say on the issue.

The cameras are popping up at intersections across our area. They're snapping photos of red light runners in Orlando, Ocoee, Palm Bay, Winter Springs and several more cities.

Supporters say the cameras not only save lives, but catch those who cause reckless accidents. But a ruling in a lawsuit filed in Aventura may change all that. A Miami judge said the fines that result from red light cameras are unconstitutional.

State Representative Ari Porth is co-sponsoring a red light legislation that has been floating around in Tallahassee for years. He believes the judge's decision and a tight budget might finally light a fire under lawmakers.

Under the plan, half of the $155 fine would go to the state, with $25 of each ticket going to support trauma centers. While safety is important, Porth believes the search for cash may finally motivate lawmakers to legalize the cameras that cities have been using for years.

The judge's ruling doesn't immediately affect red light cameras in Central Florida. Since the judge didn't issue an injunction against the program, the city of Aventura can fine drivers using the cameras while officials appeal the decision.
