ORANGE COUNTY, Fla. — A judge is considering whether to grant a new trial for the estranged daughter of actor Billy Bob Thornton who was convicted in the death of a 1-year-old girl.
In May, Amanda Brumfield was found guilty of manslaughter after a toddler she was watching died from head injuries back in 2008.
Defense attorneys argued the child fell out of a playpen and hit her head. Prosecutors say the height of the fall was too short for a fatal injury. Brumfield was scheduled to be sentenced on Thursday, but instead her attorneys argued for a new trial.
A ruling was not made on Thursday and no time frame has been set for a decision.
"We all agree this case was a battle of the experts. We all agree that causation was critical and timing of injury was everything," said defense attorney David Barszcz.
The judge is now considering whether to grant a new trial.
