Woman accused of infecting man with HIV denies allegations

ORANGE COUNTY, Fla. — An Orange County woman accused of knowingly infecting her ex-husband with HIV denies she gave him the disease.

Shawna Smith believes his accusations are really aimed at trying to gain full custody of their child.

She said he took their 1-year-old son Tuesday as she was being arrested and has not yet returned him to her.

Smith said she’s worried about the boy’s safety.

“I want my baby. My baby has kidney problems and he doesn’t have his medication,” she said.

Court documents show Smith has full custody of the couple’s son and the boy’s father has court permission to see him every other weekend.

The records show Smith has a permanent injunction against the father, who asked not to be identified, after accusing him of domestic violence.

Smith claims that last week, she and her ex-boyfriend had another argument over child support and she threatened to report him for not meeting his obligations.

Smith’s ex reached out to Channel 9 on Tuesday shortly after her arrest.

He said they were married and insists it was not until they broke up nine months ago that he found out Smith was HIV positive.

He showed documentation indicating he tested positive for HIV the next month.

“I had no clue. She hid it well. She hid it well,” he said.

Almost 10 years ago, Smith was found guilty of prostitution and the alleged victim got out of prison three years ago, after serving nine years for armed robbery.
