KISSIMMEE, Fla. — An Orange County couple claims a huge mistake by a home builder left them without a place to live.
It's a company Action 9 investigated before after customers claimed it didn't finish their homes.
Todd Ulrich confronted the builder for answers and found the state just took action against its contractor.
Two years after the new home was supposed to be done, Jenny Rullan and Francisco Vega still can't move in.
The couple signed a $145,000 contract with KCV Custom Homes and it can't pass final inspection because there's no septic system. They claim KCV's attempt to build it failed, then the company stopped trying.
"It's awful. It just is. I can't just deal with it," said Rullan.
The couple's been forced to live in a motel for two years.
Action 9 first investigated the builder 10 months ago after Sheyla Lopez paid for a home in Kissimmee. KCV had stopped building it even though it had her cash.
Since Ulrich's investigation, the state found probable cause that KCV's contractor violated state regulations by abandoning the job but keeping the customer's funds.
"I don't want any pity, just comply with what the contract says," said Lopez.
The company is rated F at the BBB for unanswered complaints.
Another home buyer just won a $100,000 judgement against KCV. According to the judgement, the home buyer was a victim of civil theft.
At KCV's main office Todd Ulrich tried to talk to manager Richard Rivera and he asked Channel 9 to turn the cameras off.
Later Rivera said the county demanded a surprise variance and costly retaining wall for the septic system, but it's not responsible to pay for change orders and he claims the buyers breached their contract.
"I don't know what else to do," said Jenny Rullan.
KCV said Sheyla's project stalled because she stopped paying, and it's challenging the state's finding.
