Haleigh Reportedly Strangled, Dumped In Lake

JACKSONVILLE, Fla. — An attorney for Misty Croslin's brother, Hank "Tommy" Croslin Jr., says his client saw 5-year-old Haleigh Cummings taken from her home in a bag.

Attorney Jim Werter says Tommy told him their cousin, Joe Overstreet, came over the night Haleigh disappeared to borrow a hunting rifle and then got angry when he didn't get it. The attorney says Tommy told him Haleigh was most likely strangled in her home by Overstreet.

Werter says Tommy and Overstreet drove the girl to a Putnam County boat ramp where she was dumped into the St. Johns River. Werter wouldn't say what Tommy was doing inside the home, but he said Tommy described the girl as limp and quiet as the men drove to the dock.

"The gun wasn't there. Joe Overstreet lost his temper and took or did something to Haleigh that evening," Werter said. "Two of these people have not been in contact with each other while in jail, so it was not like they are collaborating on stories. It gives it more credibility, though there may be variances. That is a normal thing with different witnesses seeing different things."

Neither Tommy nor Overstreet have been charged in the case. Overstreet's attorney has said he had nothing to do with Haleigh's disappearance in February 2009.

Haleigh remains missing. Investigators won't discuss any information about the case.
