ORANGE COUNTY, Fla. — The fourth day of testimony in the Caryn Kelley trial was filled with emotion on Thursday.
Kelley is accused of shooting her boyfriend, Phillip Peatross, to death inside her College Park home in 2011.
Jurors on Thursday watched video that was taken in an interview room at Orlando Police headquarters. The video was taken right after Kelley was informed of Peatross' death.
She appeared to have difficulty watching the video in court and had trouble keeping her emotions in check.
"Miss Kelley, you'll have to try to maintain your composure. I'll have to ask you to leave the courtroom," the judge said.
"I'll try my best," said Kelley.
The trial got a late start Thursday while attorneys worked to figure out how much video to show jurors of Kelley during that interview.
In the video, Kelley is wrapped in a blanket, flailing around and putting her head on the table. She becomes extremely emotional.
But a detective testified that she believed Kelley already knew Peatross was dead.
"Did you have any indication the defendant knew the victim was dead before that outcrying in the room?" asked prosecutor Candra Moore.
"Yes," said Detective Patrick Schneider.
Kelley is accused of shooting Peatross to death during a drunken argument. Her defense contends that Peatross took the gun and shot himself.
The defense appeared to be trying to get a detective on the stand to say there was a struggle over the gun, and that it's possible Peatross walked across the room and took the gun.
Late in the day, defense asked for a judgment of acquittal, saying evidence isn't there to move forward.
"Drinking while handling a gun is insufficient for manslaughter," said defense attorney Diana Tennis.
But the judge denied that request and will let jurors decide the case.
