Shots fired during fight over restroom at Daytona Beach store

DAYTONA BEACH, Fla. — Police said a Daytona Beach convenience store owner opened fire during a dispute over letting a customer use the bathroom.

Police said Marvin Stinson walked into the Stop N Save just before 1 a.m. Saturday and asked the store owner, Vikesh Patel, and an employee, Hemant Patel, if he could use the restroom.

Stinson became angry and belligerent when he was told the restroom was not open, according to reports.

Witnesses told police the employees followed Stinson out of the store and a fight ensued between the store owners and Stinson.

Surveillance video and witness reports indicated Vikesh Patel fired two shots as Stinson was leaving, police said.

Hemant Patel was arrested and charged with battery while Vikesh Patel was charged with aggravated assault with a deadly weapon.
