9 Investigates past issues with deputy accused of pulling out gun on tow truck driver

ORANGE COUNTY, Fla. — 9 investigates has learned an Orange County deputy under investigation for a heated exchange with a tow truck driver has been arrested before.

Cellphone video showed Deputy Tracy Weiss, 45, flashing her badge and berating a tow truck driver last week.

Weiss returned to work Wednesday after taking some time off after the incident with the tow truck driver.

Weiss was forced to hand over her patrol car, badge and agency-issued gun.

She was off-duty when her truck was towed at her mother's retirement community. The vehicle was blocking a sidewalk, which is against the community’s policy.

Weiss is also being investigated for allegedly pulling out her gun moments before the cellphone’s camera started rolling.

Her personnel file shows she has been arrested before for domestic violence in 1995.

In a handwritten note that was a part of her employment application, she alleged her ex-boyfriend broke a dish and spit in her face while in her car.

She says she slapped him and an Orange County deputy saw it, but the domestic violence battery charge was dropped because the victim didn't want to prosecute.

Records from 1989 show she was arrested by Orlando police for driving with a revoked or suspended license.

Court records show she was never convicted.

Channel 9 asked the Sheriff’s Office about the previous arrests but has not heard back.
