DELTONA, Fla.,None — A city commissioner in Deltona has called for a review into an adult store.
It was supposed to relocate several years ago because of an adult entertainment ordinance, but it never did.
Commissioner Fred Lowry said residents told him about the store after seeing a new sign.
The owner of the adult store, Dare Wear Fashions, said he's been in business in the same location for 20 years.
"We're hoping we can work with them to relocate or whatever or they'll need to come into line with our adult entertainment ordinance," said Lowry.
However, the ordinance, which keeps adult stores from opening, has only been in place since 1997.
City officials said back then, the business owner, Shaw Dresser, should have been given five years to relocate and come into compliance.
"They actually, the city dropped the ball there. We never really followed up on that to see that they did comply; which they did not," said Lowry.
According to city officials, the business was supposed to move in 2002. Commissioner Lowry is pushing to enforce that because he said he wants to create an appealing gateway into the city.
"It's a gateway to our city, so we're concerned there and with all the advertising they've been doing has really brought that to the front burner," Lowry said.
Now, city staff must review records to see what if any action can be taken against the business.
A city spokesperson told WFTV that process could take a few days.
Dresser said he has hired an attorney.
